Terms of Service
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Empire ProServe, LLC (“Empire ProServe,” “we,” “us,” or “our”), a professional cleaning services company headquartered at 4324 Marsh Ridge Rd, Carrollton, Texas, serving the Dallas-Fort Worth metropolitan area.
By requesting, scheduling, or receiving services from Empire ProServe — whether through our website at empireproserve.com, by phone, by email, or in person — you agree to be bound by these Terms. If you do not agree to these Terms, do not request or use our services.
Please read these Terms carefully before booking. They contain important information about your rights, our obligations, limitations of liability, and how disputes are resolved.
1. Services
1.1 Scope of Services
Empire ProServe provides professional residential and commercial cleaning services in the Dallas-Fort Worth metropolitan area, including but not limited to carpet cleaning, air duct cleaning, tile and grout cleaning, upholstery cleaning, mattress cleaning, area rug cleaning, hardwood and wood floor cleaning, dryer vent cleaning, shower and bathroom cleaning, stone and countertop cleaning, fiber and fabric protection, post-construction cleaning, and recurring maintenance plans.
The specific services to be performed will be agreed upon at the time of booking or confirmed prior to the start of the service appointment. Empire ProServe reserves the right to decline any service request at its sole discretion.
1.2 Service Area
We primarily serve the Dallas-Fort Worth metropolitan area, operating from our office in Carrollton, Texas. Services outside our primary service area may be available at our discretion. Contact us at (469) 210-8767 to confirm availability for your location.
1.3 Service Packages
Empire ProServe offers bundled service packages, including ProServe Essential, ProServe Signature, and ProServe Complete. The scope, inclusions, and pricing of each package are as described at the time of booking. Package contents are subject to change; the terms confirmed at the time of your booking will apply to your appointment.
1.4 Access to Property
You agree to provide our technicians with safe, unobstructed access to the areas of your property requiring service. If our technicians are unable to access the service area due to circumstances within your control, we reserve the right to treat the appointment as completed and charge the applicable service fee.
1.5 Pre-Service Preparation
You are responsible for removing fragile items, valuables, and personal belongings from the service areas prior to our technicians’ arrival. Empire ProServe is not liable for damage to items that were not removed and were not disclosed to our team prior to service.
2. Appointments and Scheduling
2.1 Booking
Appointments may be requested through our website booking form, by phone at (469) 210-8767, or by email at info@empireproserve.com. Submission of a booking request does not constitute a confirmed appointment. Your appointment is confirmed only when you receive a confirmation from Empire ProServe via SMS, email, or phone.
2.2 Appointment Windows
We offer morning (8:00 AM – 12:00 PM), afternoon (12:00 PM – 5:00 PM), and evening (5:00 PM – 8:00 PM) appointment windows. We will make every reasonable effort to arrive within your selected window. Arrival times may be affected by traffic, prior appointments, or other operational factors. Empire ProServe is not liable for delays caused by circumstances beyond our reasonable control.
2.3 Cancellations and Rescheduling
We understand that schedules change. If you need to cancel or reschedule your appointment, please contact us as soon as possible at (469) 210-8767 or info@empireproserve.com. We ask for reasonable advance notice as a courtesy to our team. Empire ProServe reserves the right to implement a formal cancellation policy in the future; any such policy will be communicated to you prior to booking.
2.4 No-Show and Inaccessible Properties
If our technicians arrive at the scheduled service address and are unable to gain access to the property, or if no authorized person is present to permit entry, Empire ProServe reserves the right to charge a trip fee. We will make reasonable attempts to contact you prior to departing the property.
3. Pricing and Payment
3.1 Pricing
Service pricing is as quoted at the time of booking. For standard packages, pricing is as listed on our website or as communicated by our team. For custom or non-standard requests, a quote will be provided prior to service. All prices are in U.S. dollars and are subject to applicable taxes.
3.2 Payment
Payment is due upon completion of services. Our ground crew will collect payment at the service location at the conclusion of the appointment. We accept forms of payment as communicated by our team at the time of service. All sales are final except as provided under our Satisfaction Guarantee in Section 4.
3.3 Accurate Quotes
We provide quotes based on information you supply at the time of booking, including property size, number of rooms, and condition of the surfaces to be cleaned. If conditions at the property materially differ from what was described, our technicians may adjust the service scope or pricing accordingly, with your prior approval, before beginning work.
3.4 No Hidden Fees
What you approve before we start is what you pay. We do not add charges after service completion without your explicit authorization.
4. Satisfaction Guarantee
4.1 Our Commitment
Empire ProServe stands behind the quality of every service we perform. If you are not satisfied with the results of your cleaning service, we will return to your property and reclean the affected area at no additional charge.
4.2 How to Request a Reclean
To request a reclean under our Satisfaction Guarantee, you must notify us by contacting (469) 210-8767 or info@empireproserve.com within a reasonable time following the completion of your service. We will schedule a reclean appointment at the earliest mutually available time.
4.3 Limitations
Our Satisfaction Guarantee applies to the specific areas and services performed during your appointment. It does not apply to:
- Conditions that existed prior to service and were not reasonably addressable by our cleaning methods
- Damage or soiling caused after our technicians have completed and left the property
- Situations where the Client has interfered with or altered the cleaned areas prior to reporting dissatisfaction
- Permanent stains, damage, or deterioration that cannot be remediated through professional cleaning
The Satisfaction Guarantee provides for a reclean only and does not entitle the Client to a refund unless otherwise agreed in writing by Empire ProServe.
5. Property and Liability
5.1 Insurance
Empire ProServe carries liability insurance covering our operations. Our technicians are background-checked and trained professionals. In the event of damage caused directly by our technicians during the performance of services, please notify us immediately as described in Section 5.3.
5.2 Pre-Existing Conditions
Empire ProServe is not liable for damage to surfaces, materials, or items that are in a pre-existing weakened, damaged, or deteriorated condition prior to service. This includes, but is not limited to, worn carpet fibers, pre-existing grout cracks, loose or improperly installed flooring, delicate or improperly sealed natural stone, aging upholstery fabrics, and structural issues within air duct systems. Our technicians will make reasonable efforts to identify and communicate such conditions prior to beginning work.
5.3 Damage Claims
If you believe our technicians have caused damage to your property during the course of service, you must notify Empire ProServe within forty-eight (48) hours of the completion of the service appointment by contacting (469) 210-8767 or info@empireproserve.com. Failure to report damage within this window may limit our ability to investigate and respond to the claim. Empire ProServe will review all damage claims in good faith and work toward a fair resolution.
5.4 Hazardous Conditions
Our technicians reserve the right to refuse or suspend service if they encounter conditions at the property that present a risk to their health or safety, including but not limited to the presence of biohazardous materials, infestation, structural hazards, hostile or threatening behavior, or conditions that exceed the scope of professional cleaning services. In such cases, a partial service fee may apply for work already performed.
5.5 Limitation of Liability
To the fullest extent permitted by applicable law, Empire ProServe’s total liability to you for any claim arising out of or related to the services performed shall not exceed the amount paid by you for the specific service appointment giving rise to the claim. Empire ProServe shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of use, loss of revenue, or loss of business opportunity, even if we have been advised of the possibility of such damages.
6. Client Responsibilities
As a Client of Empire ProServe, you agree to:
- Provide accurate and complete information when booking services, including property address, type, size, and condition of surfaces to be cleaned
- Ensure that an authorized adult (18 years or older) is present at the property during the service appointment, or make alternative entry arrangements confirmed in advance with our team
- Secure pets in a safe location away from the service areas during the appointment
- Remove fragile, valuable, or irreplaceable items from the service areas prior to our technicians’ arrival
- Disclose any known hazards, sensitivities, or conditions at the property that may affect service delivery or technician safety
- Treat our technicians with respect and professionalism at all times
Empire ProServe reserves the right to terminate a service appointment and charge the applicable fee if a Client or any person present at the property behaves in a threatening, abusive, or unsafe manner toward our technicians.
7. Intellectual Property
All content on empireproserve.com, including text, graphics, logos, images, and service descriptions, is the property of Empire ProServe, LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without our prior written permission.
8. Communications and Marketing
By submitting a booking request or contacting us, you consent to receive service-related communications from Empire ProServe via SMS, email, and phone. These include appointment confirmations, reminders, and follow-up messages related to your service.
With your consent, or as permitted by applicable law, we may also send you promotional communications. You may opt out of marketing communications at any time by replying STOP to any SMS, clicking unsubscribe in any email, or contacting us directly. Opting out of marketing does not affect service-related communications.
9. Indemnification
You agree to indemnify, defend, and hold harmless Empire ProServe, LLC, its officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your misrepresentation of property conditions, size, or access; (c) injury or damage caused by conditions at your property that were not disclosed to our team prior to service; or (d) your violation of any applicable law or third-party rights.
10. Governing Law and Dispute Resolution
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
10.2 Informal Resolution
Before initiating any formal dispute process, we encourage you to contact us directly at (469) 210-8767 or info@empireproserve.com. Most concerns can be resolved quickly and informally. We are committed to fair and good-faith resolution of all client concerns.
10.3 Jurisdiction
Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas. You consent to personal jurisdiction in those courts.
11. Modifications to These Terms
Empire ProServe reserves the right to update or modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this document. Your continued use of our services after changes have been posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
12. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Empire ProServe with respect to your use of our services and supersede all prior agreements, representations, and understandings. No oral statements or prior written materials not included in these Terms shall be of any force or effect.
